Terms of Service

These Terms of Service ("Terms") govern your use of the JackPop Shopify app and the JackPop website at jackpop.app. By installing the app or using the website, you agree to be bound by these Terms. If you do not agree, do not use JackPop.

1. Acceptance of Terms

By installing JackPop from the Shopify App Store or using our website, you agree to these Terms and our Privacy Policy. If you're installing the app on behalf of a business, you represent that you have authority to bind that business to these Terms.

2. Description of Service

JackPop is a Shopify app that provides a gamified discount popup for Shopify storefronts. Merchants can configure the popup's appearance and behavior, and customers can play games to win discount codes that are applied to their purchases.

3. Merchant Accounts and Responsibilities

As a merchant using JackPop, you agree to:

• Use the app in compliance with Shopify's Terms of Service and Partner Program requirements
• Not misrepresent your store or engage in deceptive practices
• Not use JackPop to distribute offensive, illegal, or harmful content
• Configure discount settings responsibly and honor the discounts customers win
• Maintain the security of your Shopify store and account

4. Subscription and Billing

JackPop offers three subscription plans:

• JackPop Lite — $24.99 USD per month (displays "Powered by JackPop" branding)
• JackPop Premium — $29.99 USD per month (no branding)
• JackPop Annual — $239.88 USD per year, billed annually (no branding)

Billing is handled by Shopify. Charges are processed through your Shopify account. Prices are subject to change with 30 days notice. Existing subscribers will be notified of any changes before renewal.

5. Free Trial

All plans include a 7-day free trial. No charges occur during the trial period. If you do not cancel before the trial ends, your chosen plan will be billed automatically.

6. Cancellation and Refunds

You may cancel your subscription at any time through the JackPop billing page or by uninstalling the app from your Shopify admin. Cancellation takes effect at the end of the current billing period.

We do not provide refunds for unused portions of a billing period, including annual subscriptions canceled mid-year. Access to JackPop continues until the end of the paid period.

7. Acceptable Use

You may not:

• Reverse engineer, decompile, or attempt to extract source code from JackPop
• Use JackPop to conduct fraudulent activities or spam
• Interfere with or disrupt the JackPop service or servers
• Resell or sublicense JackPop to third parties
• Use JackPop to collect information for unauthorized purposes

8. Intellectual Property

JackPop and all related trademarks, logos, code, and content are the property of JackPop. You are granted a limited, non-exclusive, non-transferable license to use the app for its intended purpose during your active subscription.

Merchants retain full ownership of their store data, customer data, and content. JackPop claims no ownership over merchant content.

9. Third-Party Services

JackPop integrates with Shopify and may link to third-party websites or services. We are not responsible for the content, privacy practices, or availability of third-party services. Your use of third-party services is governed by their own terms.

10. Disclaimers and Warranties

JackPop is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that:

• The app will be uninterrupted, secure, or error-free
• Results from using JackPop will meet your specific expectations
• Any errors will be corrected

We specifically disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of Liability

To the maximum extent permitted by law, JackPop shall not be liable for:

• Indirect, incidental, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Damages exceeding the amount paid by you for JackPop in the 12 months preceding the claim

This limitation applies regardless of the legal theory of liability.

12. Indemnification

You agree to indemnify and hold JackPop harmless from any claims, damages, losses, or expenses arising from your use of the app, your violation of these Terms, or your violation of any third-party rights.

13. Changes to the Service

We may modify, suspend, or discontinue JackPop or any part of it at any time. We will provide reasonable notice of significant changes to active subscribers.

14. Termination

We may terminate or suspend your access to JackPop immediately, without prior notice, if you violate these Terms, engage in fraudulent activity, or fail to pay subscription fees.

Upon termination, your right to use JackPop ends. All provisions of these Terms that should survive termination will remain in effect, including intellectual property, disclaimers, and limitation of liability.

15. Governing Law

These Terms are governed by the laws of New Zealand, without regard to conflict of law principles. Any disputes arising from these Terms or your use of JackPop shall be resolved in the courts of New Zealand.
